The limits of legal advocacy and free speech are being challenged in a well-known case involving Meta and one of its main critics. Lawyer Ravi Naik, who represents Meta whistleblower Sarah Wynn-Williams, has stated that he cannot promote her memoir, Careless People, due to legal restrictions.

This news comes after a controversial event at the Hay Festival, where Wynn-Williams had to sit in silence for an hour during a panel discussion because of a strict arbitration decision.

The Gag Order: Beyond the Author

The legal hurdles facing Wynn-Williams have now extended directly to her legal representation. Ravi Naik, legal director at the law firm AWO, confirmed that the terms of an arbitration proceeding—handed down in California—restrict not only his client but also her “agents” from promoting the book or making disparaging remarks about the social media giant.

“Never in my life have I faced a circumstance where my client cannot speak about her truth and I as a lawyer cannot speak on behalf of my client,” Naik stated during an interview on BBC Radio’s Today programme.

According to Naik, this is not merely a hypothetical concern. Meta has explicitly warned that they consider any promotion of the book a breach of the interim arbitration award. The company has indicated that it would seek “punitive” damages—potentially enforceable through British courts—should Wynn-Williams or her team violate these terms.

The Hay Festival Standoff

The severity of these restrictions was made public during a scheduled event at the Hay Festival. Wynn-Williams, who was slated to discuss her experiences with investigative journalist Carole Cadwalladr and academic Tim Wu, sat on stage entirely motionless and silent.

The scene prompted Cadwalladr to remark, “I think this might be a Hay first, in which we have an author in a hostage situation.”

Meta’s Position on the Allegations

Meta has consistently denied the claims made in Careless People, describing the memoir as a collection of “out-of-date and previously reported claims” combined with “false accusations about our executives.”

The company maintains that Wynn-Williams’s departure in 2017 was due to “poor performance and toxic behaviour,” allegations that Wynn-Williams has countered throughout her whistleblowing journey. Previously, Senator Josh Hawley highlighted claims that Wynn-Williams faced massive financial penalties for every public mention of Facebook, while Meta contends these damages are tied to the separation agreement she signed upon leaving the firm.

Why This Matters for Free Speech

This case has started a bigger discussion about how companies use arbitration clauses to silence former employees and their representatives. Critics, like Labour MP Louise Haigh, say that Meta’s legal tactics aim to drive whistleblowers toward financial ruin instead of truly addressing their claims.

As the legal battle continues, Sarah Wynn-Williams’ silence clearly shows a complicated corporate and legal strategy. Meta’s leaders defend this strategy as a way to enforce confidentiality agreements.
